My telegram No. 5.

It has been suggested to Hasao by Lisbon that matter

should be referred to a tribunal of three, one Portuguese,

one Chinese and a "oasting vote" (Tas) modus vivendi pending

delimitation. Madao has rejected this and rightly so in my

opinion and has put forward arbitration by foreign consul or

other high official nominated jointly.

I omsider this squally unsatisfactory, because I

(† damot) visit Portuguese Minister if Chinese do not agree

to accept his mediation (see Peking telegram No. 369).

I am consulting chinese on above in writing today,

and have added on my responsibility, suggestion that harbour

and watere queation be submitted to His Majesty's Supreme

Gourt at Shanghai, as being without local prejudies and,

therefore, impartial.

Are you prepared to endorse and sanation this proposal?
